LARKINS, District Judge:

This action is brought to enjoin defendants from violating the provisions of Sections 15(a) (2) and 15(a) (5) of the-Fair Labor Standards Act of 1938, as amended (29 U.S.C. § 201 et seq.), hereinafter referred to as the Act, and to restrain defendants from withholding payment of minimum wage and overtime *16compensation alleged to be due certain of their employees under the Act.

The cause was heard by the court, sitting without a jury, at Wilson, North Carolina, on September 10, 1963. Before the trial the parties entered into numerous stipulations. There are only three…
