KRUEGER, JUDGE.

The offense is burglary; the punishment, 2 years confinement in the state penitentiary.

On the 12th day of April, A. D. 1933, the appellant was indicted by the grand jury of Dawson County of the offense of burglary. He was arrested on the same day and on the 21st of April employed an attorney to represent him at the trial. On the 27th day of said month his case was called to trial when he and his counsel appeared, filed an application for a suspended sentence, and entered a plea of guilty to the charge.
