Action by Thomas Larkin against the village of Brockport. There was a verdict in favor of plaintiff on hi® first cause of action, and a nonsuit as to the second cause of action, and both parties move for a new trial on exceptions ordered to be heard at general term in the first instance. Plaintiff’s motion denied. Defendant’s motion granted.

1Opinion of the CourtLewis, J.

The legislature, in the year 1887, upon the solicitation of the citizens of the village of Brockport, passed an act making .an appropriation of money for the construction of a lift bridge over the Erie Canal in said village. It was provided in the act that the operation of the bridge should be under the direction of the superintendent of public works, but that the expense incurred in operating the bridge should be paid by the village of Brockport. The bridge was constructed, and the superintendent of public works, in the spring of 1888, appointed the plaintiff as one of two men to operate it,…
