Affirming.
The appellant, Hillard Phillips, was indicted by the grand jury of Pike county, charging him with the willful murder of Jarvey Ward, and upon trial he was con victed of manslaughter and his punishment fixed at four years’ confinement at hard labor in the state reformatory at Frankfort, Ky.
His motion and grounds for a new trial having been overruled, he appeals.
