THIS CAUSE has come before the Court upon the appeal of the order of The Hon. A. Jay Cristol, United States Bankruptcy Judge for the Southern District of Florida, dated January 31, 1990. 110 B.R. 599. FACTS

The debtor, Paula Lea McCollam (“McCo-llam”), is a beneficiary under an annuity contract purchased by Travelers Insurance Co. (“Travelers”). McCollam, as a survivor of her father, was awarded this contract on July 9,1985 as part of a settlement of a her father’s estate’s wrongful death claim.
