OPINION
WOODLEY, Presiding Judge.
The offense is assault with intent to murder; the punishment, 25 years.
The indictment, returned January 31, 1966, alleged that the assault was made upon Velma Pauline McLemore on or about November 16, 1965. A prior conviction for a like offense was alleged for enhancement of punishment purposes.
Trial was before a jury. Having been found guilty of the primary offense, appellant requested that the punishment be assessed by the jury. Further evidence having been heard, the jury found the allegations as to the prior conviction were true and assessed the maximum…
