SWAIM, Circuit Judge.

This appeal is from an order of the District Court of the United States for the Northern District of Illinois, Eastern Division, discharging a writ of habeas corpus and remanding the petitioner to the custody of the warden of the Illinois State Penitentiary. The trial court issued a certificate of probable cause.

The petition questioned the validity of the conviction and judgment of the Criminal Court of Cook County, Illinois, which adjudged the petitioner guilty of armed robbery and of being an “habitual criminal” under the Illinois Habitual Criminal Act, Chap. 38, § 602…
