WILBUR, Circuit Judge.

On March 12, 1929, appellant shipped as a digester loader on the whaling ship> “Lansing” for a whaling voyage to Magdalena Bay, Mexico. The voyage is described in the articles as follows:

“ * * * From the Port of San Francisco, California, to Magdalena Bay, Mexico, and such other ports and places in any part of the Pacific Ocean as toe master may direct on a whaling voyage and back to San Francisco, California, a final port of discharge in the United States, 'for a term of time not exceeding twelve calendar months.”
