1Opinion of the Court

The opinion of the court was delivered by

Smith, J.

The original action was brought by the paintiff in error against the defendants, on the 11th of December, 1823, to *136recover the value of certain goods sold and delivered. The' defendants pleaded non assumpserunt, and non assumpserunt infra sex annos. Issues were joined, and, at the trial, a verdict was returned for the defendants, and judgment thereon rendered. Certain points had been presented to the court, to the answers to which, exceptions were taken by the plaintiff’s counsel, and are now assigned here for error.
