In this action to recover damages for personal injuries the plaintiff recovered a judgment before. Justice Bremer in December, 1903. .Within the five days prescribed in section 254 of the Municipal Court Act the defendant moved before Justice Bremer to set aside the judgment and for a new trial. The term of the justice expired on January 1, 1904, and up to that time he had not decided the motion, but undertook to do so, and to make an order vacating the judgment several days after he had ceased to hold the office of justice.
