ROTH, P. J.

James and Dorothy Birch were married in Texas in December of 1942. They had two children, Robert and Margaret. In apparent anticipation of dissolution of the marriage, the couple, then living temporarily in Germany, entered into a written property settlement agreement in 1962. On April 5,1963, a judgment of divorce between them was entered in the State of Chihuahua, Republic of Mexico.
