This is a civil action brought to recover on a fire insurance policy commenced by a summons and complaint served on the state Insurance Commissioner at his office in Providence on July 23, 1969. No answer was filed thereto within 20 days as is required by the pertinent provisions of Rule 12 (a) of Super. R. Civ. P.
