In an action, inter alia, to recover damages for an alleged breach of fiduciary duty, the plaintiff appeals, as limited by his brief, from so much of an order of the Supreme Court, Suffolk County (Molia, J.), dated January 25, 2006, as, upon reargument, in effect, vacated a prior order of the same court dated December 5, 2005, denying the defendants’ motion pursuant to CPLR 3211 (a) (7) to dismiss the complaint for failure to state a cause of action, and granted the motion to dismiss.
Ordered that the order is affirmed insofar as appealed from, with costs.
