1Opinion of the CourtAlbert, J.

Hickman avenue, within the limits of the city of Des Moines, runs approximately in an easterly and westerly direction. It is a part of the national system of highways, known as Primary Road No. 6, and carries a heavy burden of traffic both day and night. This street is paved with brick, cushioned in sand on -a concrete bed; and on either side, to hold the brick in place, is a 5-inch header which is constructed of concrete. The paved portion is 20 feet wide over all. At a point on the south side of said pavement, and about 60 feet west of Sixty-first street, the header was entirely broken off…
