OPINION AND ORDER

This matter came before the court on plaintiffs motion to remand the ease to the Circuit Court for the City of Virginia Beach. For the reasons stated below, plaintiffs motion to remand is DENIED.
I. Factual and Procedural History
The facts pertinent to the instant motion to remand are essentially undisputed.1 In April, 1997, Michelle McKnight (“McKnight”), the president and sole shareholder of defendant 1969, Inc., d/b/a Lands-harks Inshore Eatery, received a letter from plaintiffs counsel.
