WILLIAMS, District Judge.
This action was brought by the plaintiff against the defendants, Southern Railway Company and Atlantic Coast Line Railroad Company, to recover damages alleged to have been sustained by the plaintiff in a collision with a train operated by the Southern Railway Company across Green Street in the City of Columbia, State of South Carolina. The case was tried before me and a jury on June 13, 1955. At the conclusion of the testimony for the plaintiff, each of the defendants moved for an order of dismissal.
