On the 3d of March, 1899, a judgment was recovered by the plaintiff against the defendant, and an appeal to the Court of Appeals having been dismissed, final judgment was entered on the 18th of May, 1899. Oh the third of March the plaintiff’s attorney, who is the appellant here, gave to the defendant notice that he held the judgment as collateral security to secure his attorney’s lien and claim for compensation and otherwise, by agreement with the plaintiff, the attorney claiming that on that day the plaintiff had assigned the judgment to him for that purpose.
