MEMORANDUM OPINION AND ORDER

TOM S. LEE, District Judge.

This cause is before the court on the application of plaintiff Gregory Matthews for review of an order entered by the United States Magistrate Judge December 3, 1990 denying plaintiffs motion to remand. The court, having considered the memoran-da of authorities together with attachments submitted by the parties and having considered argument of counsel, concludes that the motion to remand should be denied, albeit for reasons different from those set forth in the order of the magistrate judge.
