Appeal from an order of the Supreme Court, Oneida County (Anthony F. Shaheen, J.), entered April 5, 2006 in a personal injury action. The order granted defendant’s motion to dismiss the complaint.

It is hereby ordered that the order so appealed from be and the same hereby is unanimously modified on the law by denying the motion in part and reinstating the complaint insofar as it *1238alleges that defendant was negligent in failing to provide proper illumination and as modified the order is affirmed without costs.
