delivered the opinion of the Commission of Appeals, Section A.

On January 9, 1931, the Hanover Insurance Company, hereinafter called the insurance company, issued to G. W. Stevenson a fire insurance policy for the term of one year, on a certain dwelling house belonging to Stevenson in the City of Denton. The premium was paid at the time. This suit was brought by Stevenson on the policy, for the loss of the building by fire, and in the trial court the case was tried before the court, without a jury, resulting in a judgment for Stevenson.
