John Parham brought suit in the superior court of Chattooga county for personal injuries, against the Central of •Georgia Kailway Company. On the trial of the case, at the March term, 1906, in support of his suit for damages, he testified in substance as follows: that in June, July, and August, 1904, he was •employed by the defendant company; that on or about August 13, 1904, while he was working with extra gang number 1, in charge •of a train of the defendant company, and in pursuance of his work, he was sitting on cross-ties which were loaded upon a fiat car, a part of the train, and was…
