The present case has been extensively litigated. It began originally by the filing of a declaration in the Court of Common Pleas of Baltimore City by the plaintiff and appellant, Miriam Tates Cook against three defendants, Newton Toney, the appellee, John W. Perry and Ellen M. Perry, his wife, to recover damages for personal injuries sustained in an automobile accident. A jury trial was elected and damages in the amount of $25,000 were claimed.
