LATIMER, Justice.

This is an original mandamus proceeding in this court to require defendant, Alvin Keddington, County Clerk of Salt Lake County, State of Utah, to file petitioner’s declaration of candidacy for the office of county attorney of Salt Lake County on the Democratic ticket. The dispute in this action revolves around the effective date of an amendment to our constitution.

Section 10 of Article VIII of the constitution of the State of Utah prior to 1947 was as follows:

“A County Attorney shall be elected by the qualified voters of each county who shall hold his office for a term of two…
