OPINION

NYE, Chief Justice.

Appellee Donald Adkins filed his motion to dismiss the appeal. He contends that this Court does not have jurisdiction. The motion to dismiss was set for argument along with the merits of the appeal.

On November 2, 1970, the trial court entered its original judgment for appellee. The appellant timely filed her original and amended motions for new trial. Appellee, on December 3, 1970, filed his reply to the motion for new trial.
