HIGGINS, Justice.
Plaintiffs, as co-owners in indivisión of .certain real estate, instituted a jactitation action, alleging that they were in possession of the property, and that the defendants were slandering their title by recording a purported tax deed.
The defendants answered, denying that plaintiffs had possession of the land as required by law; and, in the alternative, asserted that they were the owners of an undivided one-tenth of the property, by virtue of their tax title, and further, in the alternative, only in the event the court should hold that plaintiffs were the lawful owners of…
