This was an action brought in the district court of Jackson county by the plaintiff in error against the defendants in error, upon two promissory notes, each for the sum of $1,088.20, and to foreclose the mortgage given to secure the payment of the same. The indebtedness was created in the exchange of certain real estate owned by one of the defendants in error in Kansas City, Mo., and Butler and Chautauqua counties, Kansas, for certain real estate and a stock of goods situated in Netawaka, in Jackson county, Kansas, and owned by O.
