The petitioners were convicted of operating taxi cabs upon the streets of the city of Bismarck without having first obtained a license therefor under the provisions of ordinance No. 447 of said city. They were sentenced to jail and now apply to this court for a writ of habeas corpus upon the ground that they are unlawfully and illegally imprisoned because the ordinance in question is unconstitutional and therefore void.
