Order of the Appellate Term of the Supreme Court, First *482Department, entered May 23, 2005, which reversed an order of the Civil Court (Eileen Rakower, J.), entered October 23, 2003, which had granted plaintiffs motion to restore the action to the trial calendar, and dismissed the complaint, unanimously reversed, on the law, without costs, the complaint reinstated and the action restored to the trial calendar.
