In an action, inter alia, to recover damages for breach of contract, the plaintiffs appeal, as limited by their brief, from so much of an order of the Supreme Court, Queens County (Kitzes, J.), dated April 22, 2008, as granted those branches of the defendants’ motion which were pursuant to CFLR 3211 (a) (1) to dismiss the complaint and for summary judgment dismissing the complaint.

Ordered that the order is affirmed insofar as appealed from, with costs.
