Appeal from Clinton Circuit Court. — Hon. Wm. 8. Herndon, Judge. (1) It is not necessary to file in the circuit clerk’s office a transcript of all the entries in the docket of a justice of the peace. It is only necessary to file a transcript of the judgment rendered by the justice of the peace. E. S. 1889, sec. 6286; Eranse v. Owens, 25 Mo. 329. This is a direct proceeding by bill in equity, instituted in the Clinton Circuit Court on April 29, 1898, to set aside a sheriff’s sale and deed to 520 acres of land1 in Clinton county, Missouri, made in April, 1875, under an execution issued upon a transcript of a judgment obtained before a justice of the peace.
The land in controversy was a part of the home farm of John Beed, deceased, late of Clinton county, who died intestate in 1861, owning said land, together with a large amount of other land, and leaving surviving him the plaintiff and four other children and his widow, Mary Beed. On…
