Evans, Judge.

Shelly Denise Hardman, age two years, while visiting her grandmother, Mrs. William H. (Louise) Harris, was trapped under an automobile being driven by William Porterfield in the driveway and was injured.

Howard Hardman, individually, and as next friend of Shelly Denise Hardman, sued the grandparents and Porterfield for injuries and medical expenses arising out of the defendants’ negligence. Porterfield became in default but the other two defendants answered and denied the complaint. The grandfather died before trial and the pre-trial order notes this fact and dismissed as to him…
