The defendant is charged with operating a motor vehicle while under the influence of alcohol (Vehicle and Traffic Law § 1192 [1], [2], [3]).

Findings of Fact

On June 25, 2008, a Dunaway/Mapp /Huntley hearing was held before me. The hearing also addressed the admissibility of the results of a breathalyzer administered to the defendant more than two hours after her arrest.
