Proceeding pursuant to CPLR article 78 (transferred to this Court by order of the Appellate Division, Second Department) to review a determination of respondent Acting Commissioner of the Westchester County Department of Social Services which terminated petitioner’s employment.

The issues in this proceeding are whether the finding of *801misconduct made against petitioner is supported by substantial evidence and whether the penalty imposed was appropriate.
