Brian Joseph Bellnoa and Jeremiah J. Bellnoa, both minors, were injured when they were struck by a privately owned and operated truck while attempting to cross the street in the 3500 block of East First Street in Austin. Brian Joseph Bellnoa later died from his injuries. Appellants Jose Bellnoa and Carolyn Bellnoa (the Bellnoas) sued ap-pellee the City of Austin (the City) for damages arising out of that accident, alleging various acts of negligence relating to the regulation of traffic. 1 The trial court rendered summary judgment in favor of the City on the basis that the City was protected…
