—In a proceeding, inter alia, to obtain judicial approval of a settlement of a third-party action and to apportion the responsibility of the respective parties for legal fees incurred in settling the third-party action, Utilities Mutual Insurance Company appeals from so much of an order of the Surrogate’s Court, Nassau County (Radigan, S.), dated May 8, 1992, as extin*482guished its Workers’ Compensation lien and directed it to pay to the petitioner the sum of $74,700, representing legal fees incurred in settling the third-party action.

Ordered that the order is reversed insofar as appealed from,…
