OPINION

BONEY, Chief Justice.

Plaintiff-appellant Alaska Placer Company [hereinafter referred to as “Placer”] appeals from an order of the superior court granting the motion of defendants-appellees Richard and Phyllis Lee [hereinafter referred to as “the Lees”] to amend the judgment previously entered in favor of Placer.

In March, 1965, the Lees agreed to purchase fifteen tin mining claims from Placer. In belief that the Lees had failed to comply with certain agreed-to convenants requiring them to maintain specified daily production rates, Placer, on October 5, 1965, gave the Lees a notice of…
