The issue before this Court revolves around the propriety of the transfer of Irving Briggs by the Department of Mental Health, Retardation and Hospitals 1 (department) to the Adult Correctional Institutions (ACI) under G.L.1956 chapter 5.3 of title 40.1. Pursuant to § 40.1-5.3-9, the director of the department petitioned the Superior Court for an emergency transfer of Briggs, a sentenced inmate, from the Forensic Unit of the Eleanor Slater Hospital — where he was receiving specialized mental-health services as a psychiatric inpatient — back to the ACI…
