Certiorari issued,out of the Supreme .Court and attested on the1 8th day of December, 1909, directed to William E. Stillings, chairman, and others, commanding them to certify -an.d return to the office of the clerk of the county of New York all and singular their record and proceedings had in respect to the awarding of certain damages to the Central Trust Company-of New York, as substituted trustee under the last will and testament of Jason Rogers, deceased.

Laughlin, J.:

One Jason Rogers died seized in fee simple absolute of an entire block of land now in the twenty-third ward, borough of the Bronx, New York, and his will was duly admitted to probate on. the 11th day of September, 1868. He devised this block of land in trust, and the respondent trust company succeeded to the trust on the 26th day of November, 1906. The preniises were in the former town of Morrisania, Westchester county, and they were bounded, on the north by Home street, on the south by George (now East One Hundred and Sixty-sixth) street, on the east by Forest (or Concord)…
