The Colorado Herald Publishing Company, a Colorado corporation, plaintiff below and plaintiff in error here, brought an action in the' district court against Victor Neuhaus and the American National Bank of Denver, a national banking corporation, defendants below and defendants, in error here, to obtain a decree determining its rights and liabilities arising out of a promissory note. The cause was tried upon a stipulation of facts before the court without the intervention of a jury.
