There is a vacancy in the office of chief of the fire department of the city of Hornell. The office is in the competitive class of the civil service. The department of public safety has the duty of making an appointment to fill the vacancy. *40On December 12,1940, that department passed a resolution requesting the civil service commission “ to furnish this Department of Public Safety with an eligible list through an open competitive examination for the appointment of Chief of said department, at the earliest possible date.” The resolution further stated: “ The reason for requesting an open…
