I. INTRODUCTION

Presently before me is a Motion to Dismiss (Docket Item [“D.I.”] 19; the “Motion”) filed by defendant Howard R. Young Correctional Institution (“HRYCI”) for lack of subject matter jurisdiction pursuant to Federal Rule of Civil Procedure 12(b)(1) and for failure to state a claim upon which relief can be granted pursuant to Rule 12(b)(6).
