The bill in this case alleges that on the 25th ! December, 1837, the defendant sold to complainant a tract of land at twenty-four dollars per acre; that defendant represented -to complainant at the time of sale that the tract contained five hundred and five acres, but that he would estimate it at five hun•dred acres, which,-at twenty-four dollars per acre, made the total consideration of the sale amount to $12,000-.
