This is an interjurisdictional custody dispute over a child whom we shall call Zeke. The Barnstable Probate and Family Court (Massachusetts court) exercised jurisdiction over the custody of Zeke by issuing an order, dated June 27, 1994, appointing the child’s maternal aunt (aunt) as temporary guardian. On July 1, 1994, Zeke’s biological father (father) filed a motion to vacate temporary guardianship and enforce the order of a Texas court, contending that the Massachusetts court lacked subject matter jurisdiction.
