Appeal from an order of the Supreme Court (Krogmann, J.), entered February 9, 2009 in Warren County, which granted plaintiffs motion for an order determining that *1345a certain parcel of real property is subject to equitable distribution.
Prior to the parties’ marriage, defendant sought to purchase a parcel of land in Warren County. Because divorce proceedings were pending concerning his first marriage, defendant asked his parents to purchase the parcel, which they did in February 2002.
