OPINION AND ORDER

This matter is before the Court for decision after a bench trial. In her Amended Complaint, Elizabeth Y. Bogosian (“plaintiff’) alleges three causes of action against James H. Woloohojian (“James”), Harry Woloohojian (“Harry”), 1 and Woloohojian Realty Corporation (‘WRC”). The bench trial concerned only Counts I and II, which were brought against James and Harry (collectively “defendants”), but not WRC.
