Rodgers contends that he was terminated from his position as director of the emergency medical services department for defendant Lenox Hill Hospital in April 1992 in retaliation for his investigation into an incident in which emergency medical technicians declared a patient dead when she was in fact still alive. He brought this action seeking, inter alia, recovery of lost wages and benefits and reinstatement to his former position.
