After settling a securities class action by agreeing to pay the class members a combination of cash and stock, Enterasys Networks, Inc. (“Enterasys”) filed suit 1 against various insurance carriers seeking a declaratory judgment of coverage (Count I) and damages for breach of contract (Count II), breach of the duty of good faith and fair dealing (Count III), and violation of the New Hampshire Consumer Protection Act (Count IV).
