The district court for Johnson county entered judgment pursuant to the decision of this court in Goodman v. Smith, 94 Neb. 227, and thereupon the defendants at the *286same term of court filed a motion for a new trial on the ground of newly discovered evidence. The district court overruled the motion, and the defendants appealed to this court. Upon the motion of the plaintiff, the appeal was dismissed, and the defendants began this action in the district court for a new trial under section 8207, Rev. St. 1913.
