The appellant is a New York corporation, having its chief place of business in the city of New York. The appellee is a citizen and resident of West Virginia. Appellee alleges that the defendant, appellant here, issued, to him a policy of insurance for $1,250 upon his tobacco barn and its contents, consisting of tobacco and tobacco sticks, situated on his farm in West Virgina; that the policy of insurance was procured from their agent, A.
