Richard Lee (“defendant”) appeals the judgment entered upon his conviction by a jury of first degree assault in violation of Section 565.050 RSMo 19941 and armed criminal action in violation of section 571.015. Defendant also appeals the denial of his Rule 29.15 motion for post conviction relief after an evidentiary hearing. We find that the trial court did not err in denying defendant’s motion to dismiss based upon alleged double jeopardy and did not err in entering a written sentence finding defendant to be a prior offender despite not having specifically…
